CHP: Brandy Should Be Prosecuted for Fatal Crash

UPDATE: TMZ has obtained photos of the horrifying aftermath of Brandy's car crash.


The California Highway Patrol has recommended that singer-actress Brandy be prosecuted for misdemeanor vehicular manslaughter. A CHP source tells TMZ his department has ruled out mechanical malfunction as the cause of the crash. The source adds that the CHP believes Brandy "was just going too fast" and "was the person at fault."

If convicted, Brandy could face one year in L.A. County Jail and a $1,000 fine.

TMZ broke the story that Brandy was involved in a wreck on a Los Angeles freeway on December 30, 2006. The accident claimed the life of 38-year-old Awatef Aboudihaj. An eyewitness tells TMZ Brandy was traveling at around 65 miles per hour but did not stop when traffic in front of her slowed. Brandy's vehicle struck the vehicle in front of her and triggered a four car crash. There is no evidence of drugs or alcohol and Brandy was not arrested.

A CHP rep tells TMZ that although his department believes Brandy's negligence caused the crash, he does not believe the accident was caused by gross negligence. If officials found gross negligence, Brandy could be prosecuted for felony manslaughter.

61. Unreal. From all accounts, this was an accident. My poor brother was involved in such an accident 20 years ago. Although he was at fault, the family of the deceased person pressed no charges and neither did the police. He does not remember the accident and was horribly injured and died eventually 10 years later as a result of those injuries. I am so glad his wife and children did not suffer because someone wanted revenge for an accident. He had a perfect driving record and did not drink alcohol or ever take drugs. A good person who had an accident.

My brother's niece had a similar incident last month. She too was not prosecuted. She lost control of her SUV and slammed into a small car. The man died immediately.

In both cases, as in Brandy's, there seems to be no indication that the person was speeding, driving recklessly, maliciously, etc...Why the need for revenge? Because she's rich, a star, she had the nerve to smile several weeks later? I don't get it. I guess the truth will all come out in court. I just feel sorry for her to be judged for something that could truly happen to anyone.

By the way...Lane Garrison is jogging around LA free as a bird....

63. EVERYONE'S RIGHT. I simply said that if Brandy is charged with Manslaughter for this mistaken accident, then I DEMAND that Lane Garrison also be charged with, at the least MANSLAUGHTER or more. Brandy's accident took place on December 30 and already the CHP had decided that she should be charged. However, Lane Garrison's accident happened even earlier, on December 2 and Beverly Hills Police do not appear to be charging Lane with anything--AT ALL. Yet, Lane Garrison according to the BH Police was in fact, DRUNK. What's the hold up. Lane should already be in cuffs. HE ACTUALLY COMMITTED A CRIME, DRIVING DRUNK. Yet, TMZ showed Lane Garrison driving off in his sporty $100,00 truck just last week. This dude still has his license !!
EQUAL JUSTICE ??!!

EVERYONE"S RIGHT - RACE IS UNIMPORTANT but maybe it's a GENDER thing.

64. I don't think the investigation into Lane Garrison's case was over and because it's much more complicated will take longer to pursue. But he's in DEEP trouble, celebrity or not. I feel bad for him too because Hollywood nutures bad behavior and before you know it you're caught up in it.

66. Murdered is a rather strong and irresponsible choice of word. I'm certain that Brandy did not intend to kill anyone - she was not drunk or high - she simply misjudged the distance required to stop.

68. To rough TH!! I only hope (seriously) that you are never momentarily distracted and have something like this happen to you. It happens to EVERYONE. I'm a great driver but it almost happened to me in the same area of the 405 the other night! I almost rear-ended someone who wasn't paying attention and stopped short! As someone who's older and wiser take it from me: it's not wise to judge anyone regardless of color, wealth, status, nothing. Something bad can happen with the blink of an eye and I'm positive you'd wish people were compassionate to you because the guilt would be worse than anything anyone could do to you. Sh*t happens and it alwayyyyyyyyyyy

70. If nothing else comes of this at least we will be able to watch the news and see Farrah's "brothers and sisters" loot and burn whatever city that the trial is held in if they don't agree with the verdict. Nothing says JUSTICE louder that free TV's and the latest style of tennis shoes.

72. It was a horrible accident. She does need to be prosecuted, but not damned. Some of you people are idiots. Accidents happen, but if it were my son/sister/brother, etc., I would want someone prosecuted too. You can't blame the family or the police for just doing their job. As a famous person (I really don't care her race), she will have good lawyers & get everything reduced to the minimal punishment anyway. And Brandy will be back on her feet soon.

74. Okay, really, seriously...why is every retort against black ppl that education is not highly regarded, the latest tennis shoe and fashion are the attractions? I mean, everyone gets up in arms about the media and then buys into what they see. The racial comments (which have nothing to do with this blog) are ridiculous. If you believe that black ppl are what you see on t.v., then you don't get out much. If we believe any race is what 's being portrayed on t.v., we all need to leave our ignorant nest and venture out.

Not all blacks derive from the deepest, darkest, pits of the ghetto...and Brandy def. wasn't one who came from the hood. Her parents had money before she became a star. Give it a rest, it's good for stirring up a little blog room controversy, but really...get off your high horses and live a little. You'd be surprised with how statistics lie and the media blows images out of proportion. White or Black, Asian or Latino, we all have our dark sides, and no one race has a darker side than the other. Again, my condolences to all parties involved.

75. I would like to take this time and thank all of my supporters. It's not easy fighting racism. The white crackers have gone underground and are getting harder to dig up. We must never forget that the crackers brought us to this country in order to do their dirty work. They enslaved us for generations and now they want us to forget their dirty past. We will however, never let them forget and we deserve the restitution were are entitled to. Power to the people. NO JUSTICE, NO PEACE!!! AMEN!
