CHP: Brandy Should Be Prosecuted for Fatal Crash

UPDATE: TMZ has obtained photos of the horrifying aftermath of Brandy's car crash.


The California Highway Patrol has recommended that singer-actress Brandy be prosecuted for misdemeanor vehicular manslaughter. A CHP source tells TMZ his department has ruled out mechanical malfunction as the cause of the crash. The source adds that the CHP believes Brandy "was just going too fast" and "was the person at fault."

If convicted, Brandy could face one year in L.A. County Jail and a $1,000 fine.

TMZ broke the story that Brandy was involved in a wreck on a Los Angeles freeway on December 30, 2006. The accident claimed the life of 38-year-old Awatef Aboudihaj. An eyewitness tells TMZ Brandy was traveling at around 65 miles per hour but did not stop when traffic in front of her slowed. Brandy's vehicle struck the vehicle in front of her and triggered a four car crash. There is no evidence of drugs or alcohol and Brandy was not arrested.

A CHP rep tells TMZ that although his department believes Brandy's negligence caused the crash, he does not believe the accident was caused by gross negligence. If officials found gross negligence, Brandy could be prosecuted for felony manslaughter.

301. I think Brandy is a great person and great artist, not to mention a young mother, with a child who needs her. The same applied for the person who was killed in the accident. They no longer have a mother. Do I think it was an accident? YES!!! Do I think that irregardless of social status she should have to abide by the same rules as the rest of America? ABSOLUTELY!! It's just the harsh reality of life it sucks, but on the other hand why should anyone regardless of age, race, religion, or anything else not have to acknowledge their wrong doing?

As for all of the people who say that she will have good lawyers and be able to get through this, I would like to remind you about what happened to Martha Stewart , Michael Jackson, and Little Kim. Of course, if the alleged assailant had been O.J. Simpson or anybody on the board of Enron... who knows?
By the way, Farrah, "white crackers" is an offensive term. It was a comment aimed at all white people living in the present for actions that took place long before we were born. Your statement, "We must never forget that the crackers brought us to this country in order to do their dirty work" neglects the fact that the slave trade originated in Africa by Africans (to include African Muslims since I believe your name "Farrah" is an Arabic name). The slave trade involving Europeans was brutal, but please don't omit all of the parties guilty by involvement. To conclude, white people were involved in slavery. White people were also involved in putting a stop to it. Can you at least appreciate the people who did that and their descendents or are you going to continue to throw blanket racist remarks at us?

306. I don't disagree with you that people need to be held accountable, Amanda, there are a couple of things I have to question which should mitigate the issue:
1) What was the speed other people were driving? This is the Los Angeles Freeway, I understand people speed all the time there.
2) Does the LAPD actively enforce the posted speed limits in the area of the accident? It was 20 years ago when Forbes magazine published an editorial stating that people who obey the speed limit in this country (55 mph) are more dangerous than the people who speed.
3) Why did the traffic ahead of Brandy slow down? If everyone driving was exceeding the speed limit, and then there was a slow down, is Brandy completely at fault due to the existing conditions?
4) If Brandy had complied with the speed limit, would she still have been in a wreck because she couldn't stop in time to avoid hitting the cars in front of her because of the "slow down."
I am not against holding people accountable, but I don't believe she could control the traffic ahead of her, so I am not sure if she is totally responsible here. If she had been under the influence, I would feel differently, though.

307. I really can't believe that there is even a need to discuss this. This woman committed vehicular homicide! Yea! She was sober! Good girl! The poor thing just wasn't paying attention on a busy highway (which should clue you in to pay double attention). This is ridiculous! I live here! If anyone but a rich famous person did this, there will be nothing said. Perhaps some of the police are racist, if you insist, however, I have a white, male friend, who was driving his brand new red beemer convertable. He pulled almost exactly the same stunt, only the car in front of him got wrecked and another car hit him from behind. The car behind him got a ticket, but he was charged with vehicular homicide because the guy in the car in front of him didn't wear his seatbelt (he may have died anyway). So Jay's in jail and his wife and 3 kids have literally lost everything, including their house. He was not drunk and he did not leave the scene of the accident. He was just not paying attention. It was only an accident. He didn't mean to. As far as I know, no one gets into an accident on purpose. He knows he did wrong and so do his family and friends. We certainly don't love him any less. He is doing jail time on a plea bargain and has also been sued for everything. His pain is unbelievable. He killed a man and changed the whole life of his family. So is the fact that he was put in jail reverse discrimation? Ridiculous! Anyway, if poor, sweet, famous, discriminated against Brandy wins, we can't wait to start a new appeal! Odds anyone?

308. I am sorry for your friend, ska, and if the information about his case was presented the way Brandy's has been, I would be saying the same things for him that I have said for her.

I also think there's a real problem in this country about the type of legal assistance people get in cases like this. It's really bad when Judge Judy tells plaintiff's who are suing defendants for monetary damages after they had the defendants charged with some crime, "if I had been this guy's defense attorney, I would have given you a run for your money." We know there is a problem with plea bargains in this country.

309. As far as the law goes it is your responsibility for killing a person whether accidental or intentional, that doesn't matter. All these racists comments are ridiculous. Brandy was driving that car therefore she is fully responsible for the death of that woman. What kind of justice is one year in prison for the life of a human being? Bottom line Brandy should get life in prison.

311. She killed a woman and hurt children because of her ignorance. And because she is famous all she will get is up to a year and a little fine. If the situation would have been reversed and the dead woman had struck Brandy then the sentence would probably be much worse. My uncle got 20 years for losing control of his vehicle and destroying government property, (a light pole). He is white, the cops were black. Maybe he should file a lawsuit. Brandy shows remorse but that still wont bring those children's mama back. I hope every time she gets into a car she remembers how she screwed up innocent people's lives.

313. universalwriter: you are alright! An accident is an accident. Brandy will probably pay for this -emotionally- for the rest of her life. And! it's unfortunate that because she is a celebrity, the family will make her pay financially, too.
If this was the 'common' driver, the insurance would settle this case-end of story...and we all have near misses for one reason or another...
ALWAYS SOMEONE TRYING TO GET RICH OFF OF SOMEONE ELSE'S HARD WORK and it's very sad that someone with genuine integrity and character like Brandy (and her family) will have suffer the pains of another person seeing the $$$. Peace be with you girl...integrity:owning up to your part of responsibilty-come what may.

315. Poor Brandy! Honestly, if she weren't a celebrity, she wouldn't be getting sued. It irks me when people go after celebrities and people with money just because they can. She made a mistake. She wasn't drunk, she wasn't high and it could've happened to anyone. I seriously hope she doesn't face criminal prosecution but I'm sure she'll pay in civil court.
